To define how the MidwayUSA Foundation handles the personal information it collects on donors, supporters, and website visitors.

Introduction

MidwayUSA Foundation, Inc. strongly believes in protecting the integrity and privacy of personal information gathered from our supporters through all our communication channels and visitors to our Website. The protection of your privacy is of great importance to us. We have created this privacy policy to communicate our practices regarding the collection and dissemination of personal information that you provide to us and that can be linked to a specific individual, such as a name, postal address, telephone number(s), email address, or any other information, provided to us by our supporters and Website visitors (hereinafter “Personal Information”), as well as certain non-personally identifiable information collected when you visit many of our web pages such as the type of browser you are using (e.g. Internet Explorer or Firefox), the type of operating system you are using, the domain name of your internet service provider, aggregate data about the number of visits to the Site and/or aggregate data about the pages visited (hereinafter “Aggregate Data”).

This policy does not apply to information or data MidwayUSA Foundation purchases from other sources. See our Donor Policy for additional information on how we use the information we collect through fundraising efforts, including, but not limited to, donations from Individuals, Teams, National Partners, State Partners, and other Corporate and Organizational sponsors and donors. To the extent the Donor Policy applies and conflicts with this Privacy Policy, the Donor Policy shall be controlling.

This Policy will be posted on our Website (www.midwayusafoundation.org) at all times and updated periodically, so please reread it occasionally. The most recent date the privacy policy was updated is at the top of the page. By submitting your personal information to us, you agree that MidwayUSA Foundation may use the information in accordance with this Privacy Policy.

What information midwayusa foundation collects

MidwayUSA Foundation collects Personal Information voluntarily provided by supporters, volunteers, and website visitors to enhance our understanding of interests, improve services, and facilitate future support. Providing personal information is optional but necessary for certain site features, such as receiving information or donating. The information submitted will be used for intended purposes, including contacting you for future support or fundraising campaigns. Your information may also be used for surveys or disclosed as stated at the point of collection. We may contact you offline using your name, postal address, and telephone number. Personal Information may be shared with nonprofit or commercial organizations, including other MidwayUSA Foundation funded/sponsored shooting teams, based on your provided address for potential product, service, or offer communication. To opt out of offline contact, mailings, or information sharing, please follow the instructions in this policy’s “Opt-Out” section.

The MidwayUSA Foundation takes security very seriously. Our systems are secured through a managed IT services provider, which maintains our cloud-based storage and workstations. We use multifactor authentication (MFA) on all cloud accounts, daily offsite backups, remote monitoring and management software, managed antivirus, and endpoint detection and response (EDR) tools. MidwayUSA Foundation also utilizes a Confidential Information Policy with all of our employees. The purpose of this policy is to define the guidelines for sharing confidential information both internally and externally. External confidential information includes but isn’t limited to information about constituents, partners, programs, incentives, certain financial information, award winners, etc. Each employee agrees to uphold this policy while employed by the MidwayUSA Foundation.

how we share your information

MidwayUSA Foundation uses third-party vendors to provide services on this Website and in offline business operations. The information you submit on this site may be provided to those vendors on a confidential basis so that those vendors can provide services (such as maintaining our database, sending email messages, facilitating fundraising activities, or processing credit card transactions) on our behalf. Currently, we utilize Blackbaud for maintaining our entire database, all our donation forms and emails, and processing credit card transactions, and Survey Monkey Apply to process grants, Unanet to process product grant request, and Upland Software for the Foundation’s static digital documents. These entities practice the highest security and data protection level through encryption, tokenization, and various other methods. None of the MidwayUSA Foundation third-party vendors use the information gathered for any purpose other than to service MidwayUSA Foundation, and none will share the constituent information with any other third-party vendor. Other than as described in this Privacy Policy, or as may be necessary to protect the rights, property, and safety of our organization or others, or as may be necessary to comply with applicable law, MidwayUSA Foundation will not exchange or sell the Personal Information you provide.

MidwayUSA Foundation uses non-personally identifiable Aggregate Data information to improve the design and content of the Site and to enable MidwayUSA Foundation to personalize your Internet experience. MidwayUSA Foundation may use Aggregate Data to analyze Site usage and create services to fit your needs. Also, MidwayUSA Foundation may share this Aggregate Data with MidwayUSA Foundation’s related entities, advertisers, partners, and/or other third-party vendors. MidwayUSA Foundation shall own such Aggregate Data and maintain copies of such as part of its records.

With your permission or upon your direction, we may disclose your personal information to interact with a third party or for other purposes.

use of email address

When you donate to MidwayUSA Foundation or sign up on our Website, share your story or complete some other data form, you will be asked to supply your email address. MidwayUSA Foundation does not sell or rent your email address to any third party. MidwayUSA Foundation may share your email address with teams, State Partners, National Partners, and Corporate sponsors/supporters only for the purpose of providing information of interest to Teams or other supporters.

MidwayUSA Foundation and its network of Teams will only use your email address to send information about MidwayUSA Foundation and its members Teams (such as news and events, special programs, and fundraising). From time to time, we may send out email messages that might include information about like-missioned organizations and companies.

MidwayUSA Foundation complies with those provisions of the CAN-SPAM Act applicable to charitable organizations. All email messages contain a link to unsubscribe from MidwayUSA Foundation email. You may subscribe or unsubscribe to MidwayUSA Foundation emails at any time by sending a notice by United States mail to the contact address at the end of this policy. YOUR CALIFORNIA PRIVACY RIGHTS

As a nonprofit organization, MidwayUSA Foundation is generally exempt from the California Consumer Privacy Act (CCPA) and its 2023 amendments under the California Privacy Rights Act (CPRA). These laws apply to for-profit businesses meeting certain revenue and data-processing thresholds. However, we are committed to transparency with all our supporters, including those in California. California residents may contact us to: (1) request information about the types of personal data we hold and how it is used; (2) the right to delete your information unless we need to retain that information for a specified purpose as exempted under state law; (3) request correction of inaccurate information; (4) request that we limit sharing of their information with third parties for direct marketing purposes; and (5) opt out of future communications at any time. USER SUBMISSIONS

MidwayUSA Foundation welcomes your comments and participation through postal address and email communication. However, you acknowledge that if you send us creative suggestions, stories, photos, videos, ideas, or other information, you grant MidwayUSA Foundation a non-exclusive, royalty-free, perpetual license to use, reproduce, publish, and distribute that information in connection with our mission and activities, including for promotional purposes, without further obligation to you. You retain ownership of your submission. We will not use your personal story or likeness in a way that implies your endorsement of a commercial product without your separate written consent.

As a submitter, you are responsible for your own communications and the consequences of the information. Therefore, do not impersonate another person and do not transmit material to us that is copyrighted unless you are the copyright owner or have the permission of the copyright owner to submit it; do not send material that reveals trade secrets unless you own them or have the permission of the owner; do not send material that infringes on any other intellectual property rights of others or the privacy or publicity rights of others; do not send material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another user or any other person or entity; and do not send sexually explicit images, advertising or solicitations of business, or chain letters.

You represent and warrant that any information and/or material you provide to MidwayUSA Foundation through any medium is truthful, accurate, not misleading, not confidential property of others, and not in violation of any other third party’s rights. Furthermore, you acknowledge and agree that all submissions will become the property of MidwayUSA Foundation, and that MidwayUSA Foundation has the right to publish or republish the submission for any use, including for promotional and advertising purposes, without compensation. Should your submission include third-party materials, you grant, represent, and warrant that you, as well as the owner of such content, have expressly granted MidwayUSA Foundation a royalty-free, perpetual, irrevocable, worldwide exclusive license to use the submission in any manner, media or form now known or hereafter developed. MidwayUSA Foundation shall have the right to sublicense its rights.

USE OF “COOKIES”

The MidwayUSA Foundation Website may use “cookies” and similar means to collect aggregate statistical information. Aggregate information does not identify any individual person. A SPECIAL NOTE ABOUT CHILDREN

MidwayUSA Foundation does not accept donations from children. If you are under 18, do not donate or submit information without a parent or guardian’s expressed consent and participation. MidwayUSA Foundation does not knowingly gather personally identifiable information from children under the age of 13, in compliance with the Children’s Online Privacy Protection Act (COPPA). You must be 13 years of age or older to access the site. If we learn that we have inadvertently collected personal information from a child under 13, we will promptly delete it. MidwayUSA Foundation has no interest in collecting information from children under 13.

data retention

MidwayUSA Foundation retains personal information only for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable law. Donor and supporter records are generally retained for seven years following the last transaction or interaction to support our fundraising, grant-making, and legal compliance obligations. Website visitor data and aggregate analytics data are retained for no longer than two years. When personal information is no longer needed, we securely delete or anonymize it. You may request deletion of your personal information at any time by contacting us using the information in the Opt-Out/Contact section below. We will honor such requests subject to any legal obligations that require us to retain certain records.

data breach notification

In the event of a data breach that compromises the security of your personal information, MidwayUSA Foundation will notify affected individuals in accordance with applicable federal and state law, including Missouri’s data breach notification statute. Notification will be provided without unreasonable delay and will describe the nature of the breach, the categories of information involved, and the steps we are taking to address it. Binding Effect/Modification Of Policy And Terms

By accessing the MidwayUSA Foundation Website, you agree that the terms, combined with your use of the Website and/or services offered on or through the Website, have the same legal force and effect as a written contract with your written signature.
